Can my wifes ex get custody of the kids?
i seriously doubt if he will win custody. my fixing to be husband's ex wife has far less parental issues than they do and we have his two children with us as well as my two. let him take it to court. the court will make the ultimate decision of course but there are a couple of things you won't get a vote on. first off the kids have a right to get child support whether you want it or not. we would be fine without it as well but since his ex wasn't paying it they have begun garnishing her wages. then there is the court ordered visitation. now if they are old enough to say hey no i don't want to go i don't know much about it. my step babies are 2 and 3 years old and they have to go see their real mom every other weekend and for extended visits during summer vacation and during some holidays (that varies alternating years). you will have to find out more about that part but its hard. my little ones come home quite out of hand a lot when they have been over there for a visit due to a total lack of consistant parenting. the judge will look at prior history and examine the reasons the kids should stay at either place as well as possibly talk to them since they are definately old enough to let it be known where they feel they are better off. i wish you the best of luck here...and judges can usually tell if people actually care about the kids or if they just want to get out of paying child support. funny enough...these absent parents don't seem to realize that having the kids in the home is usually a lot more expensive then paying child support is anyway!
